Retained by Lyle Parks Entertainment for Breach of Contract
Hafif was retained by one of the most reputable and largest general contractors in Southern California, Lyle Parks Jr Construction (“LPJ”) to pursue a breach of contract case against an owner/developer after LPJ constructed an $87,000,000 shopping center in San Diego County but was not fully paid. Despite having to fend off the defense allegations of delay damages, cost overruns, and construction defects, there was no mercy to the defense. Stop notices and mechanics liens in excess of ten million dollars were placed on the owner’s property and on the other end, consecutive week long depositions were taken of key players to the scheme, which together, ultimately resulted in LPJ getting paid. Although the terms of the settlement are confidential, the owner of Lyle Parks, Inc., Tim Mayeda, was pleased with the result. Even Steve Nichols, defense counsel from Ratan & Tucker, LLP, appreciated Hafif's tenacity and congratulated her on a job well done.
